Selskabet fungerer som ejendomsselskab i henhold til KAGB § 234. Selskabet er underlagt de lovgivningsmæssige rammer gældende for sådanne selskaber og er dermed underlagt følgende begrænsninger i Selskabets aktiviteter: (i) I henhold til KAGB § 235, stk. 1, nr. 1, er Selskabets aktiviteter begrænset til aktiviteter, der er tilladt for et ejendomsselskab i henhold til den tyske kapitalanbringelseslov, og til aktiviteter, som Ejeren i henhold til kapitalanbringelsesloven og Fondens fundats må udøve direkte på vegne af og for Fondens regning. (ii) I det omfang Fondens fundats, henholdsvis en udtrykkelig erklæring fra Fondens kapitalejere, i henhold til KAGB § 284 ikke afviger fra KAGB § 235, stk. 1, nr. 2, må Selskabet alene købe aktiver, som er defineret i KAGB § 231, stk. 1, nr. 1-5 og nr. 7, og stk. 3, eller ejerandele i andre ejendomsselskaber som defineret i KAGB § 238, som Ejeren i henhold til Fondens fundats må købe direkte på vegne af og for Fondens regning. (iii) I det omfang Fondens fundats, henholdsvis en udtrykkelig erklæring fra Fondens kapitalejere, i henhold til KAGB § 284 ikke afviger fra KAGB § 235, stk. 2, nr. 1 og 2, må Selskabet alene købe et aktiv, hvis det pågældende aktiv er blevet behørigt værdiansat forud for købet.
